Overview

Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Skybox, an athletics operations and communications platform operated by Row9 LLC ("Row9," "we," "us," or "our"). By accessing or using Skybox, you agree to be bound by these Terms.

If you are using Skybox on behalf of a school, athletic program, or organization, you represent that you have authority to bind that organization to these Terms.

Skybox is currently available by invitation only as part of a managed pilot program. Access is granted at the sole discretion of Row9 LLC.

Description of Services

Skybox is a managed athletics communications platform that provides:

Row9 operates all backend systems and workflows. Participating schools and athletic directors access the platform through email notifications, SMS alerts, and web-based interfaces provided by Row9.

Acceptable Use

You agree to use Skybox only for lawful purposes and in connection with legitimate athletic program operations. You agree not to:

SMS Communications & Opt-In

Skybox sends transactional SMS messages related to athletic event operations. By providing a phone number in connection with Skybox services, you provide express consent to receive operational SMS messages including game confirmations, postponement alerts, and officials notifications.

All SMS messages sent through Skybox are strictly operational and transactional. We do not send marketing or promotional messages.

Section 4

Intellectual Property

All software, code, designs, workflows, documentation, and materials comprising the Skybox platform are the exclusive property of Row9 LLC and are protected by applicable intellectual property laws.

Participating schools retain ownership of their own athletic schedule data and game records. Row9 retains ownership of all platform software, automation logic, and system architecture.

Confidentiality

Pilot participants may have access to non-public features, workflows, and operational details of the Skybox platform. You agree to keep such information confidential and not disclose it to third parties without prior written consent from Row9. Separate Non-Disclosure Agreements may apply to pilot participants.

Disclaimers

Skybox is provided "as is" and "as available." Row9 makes no warranties, express or implied, regarding the platform's reliability, accuracy, or fitness for a particular purpose. We do not guarantee uninterrupted service or that all communications will be delivered successfully due to factors outside our control (including carrier restrictions, school email filtering, and third-party platform availability).

Section 7

Limitation of Liability

To the maximum extent permitted by law, Row9 LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Skybox, including but not limited to missed game confirmations, scheduling errors, or communication failures.

Row9's total liability for any claim arising under these Terms shall not exceed the fees paid by the applicable school in the three months preceding the claim, or $100, whichever is greater.

Section 8

Termination

Either party may terminate participation in the Skybox pilot program at any time with reasonable written notice. Row9 reserves the right to suspend or terminate access to the platform immediately for violation of these Terms or for any other reason at our sole discretion.

Section 9

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in North Carolina.

Section 10

Changes to Terms

Row9 may update these Terms from time to time. We will notify participating schools of material changes. Continued use of Skybox after changes are posted constitutes acceptance of the updated Terms.
